What is this?
A settlement agreement is the document used to record agreed exit terms and the waiver of specified employment claims. A proper check usually focuses on whether the agreement identifies the parties, payments, claims being waived, confidentiality or post-termination duties, tax wording, and the independent adviser certificate required for a valid statutory settlement.
Relevant law often includes the Employment Rights Act 1996 and other employment legislation governing settlement of statutory claims, together with contract and tax considerations.
