What is this?

An IVA proposal review usually looks at the debtor's assets, liabilities, income, expenditure, creditor list, proposed contributions, and the supervisor's explanatory papers. The core issue is whether the proposal is internally coherent, accurately evidenced, and suitable for the debtor's financial position before creditors are asked to vote on it.

Relevant law often includes the Insolvency Act 1986, the Insolvency Rules, and current insolvency practice governing IVAs.

Key legal requirements

• the statement of affairs, income and expenditure, asset values, and creditor balances should be evidenced and internally consistent
• the contribution model, term, fees, windfall treatment, and variation assumptions should be clear enough to understand the true arrangement offered
• creditor treatment, exclusions, secured debt position, and any contingent liabilities should be described accurately
• the proposal, nominee report, and supporting financial documents should not conflict on material facts or viability
