What this check covers

A social housing tenancy review usually looks at the tenancy type, allocation background, rent and arrears position, landlord decisions, and any notice or possession materials affecting the occupier's status. These cases differ from private AST matters because the tenancy regime and landlord duties may be materially different.

Many social lettings in England are assured tenancies under Housing Act 1988 Section 1 (a dwelling let as a separate dwelling to an individual who occupies it as their only or principal home, subject to Schedule 1 exclusions). Where the tenancy is a secure tenancy, Housing Act 1985 Section 86A sets who is qualified to succeed on the tenant’s death in England (for example a spouse or civil partner occupying as their only or principal home, with further rules where the deceased tenant was already a successor under section 88). Social housing rights and procedure still depend on the exact tenancy type, the landlord, and the part of the UK involved.

Key legal requirements

• the landlord type, tenancy status (including whether Housing Act 1988 Section 1 assured status applies), property details, and occupation history should be established clearly
• rent, succession (including Housing Act 1985 Section 86A where relevant), transfer, anti-social behaviour, repair, or possession issues should be analysed under the correct social housing route
• notices, policies, and decision letters should align with the tenancy regime and the landlord's statutory or policy obligations
• the tenant's correspondence, household circumstances, and housing file should support the position being advanced
