Section 8 grounds evidence (UK)

A Section 8 notice is a statutory possession notice used to seek possession of an assured tenancy or assured shorthold tenancy by relying on one or more grounds in Schedule 2 to the Housing Act 1988.

What is this?

A Section 8 notice is the notice used when a landlord seeks possession by alleging one or more statutory grounds, such as rent arrears, breach of tenancy, nuisance, or another Schedule 2 ground. Whether the notice is valid depends on using the correct form, citing the correct grounds, and serving it with the correct notice period.

This route is mainly used in England and Wales, but the available grounds, forms, and procedural detail must always be checked against the current national rules.

Key legal requirements

  • the tenancy, property, parties, and arrears or breach chronology must be identified accurately
  • the notice must cite the correct statutory grounds and give the correct notice period for those grounds
  • the evidence relied on should match each ground pleaded, especially for arrears, nuisance, damage, or false statements
  • the landlord should be able to show proper service and a clear link between the notice and the later court claim

Why this matters

If the wrong grounds are used or the evidence does not support them, the possession claim may fail or require amendment, causing cost and delay.
