Property deposit (UK)

A sum of money paid by a tenant to a landlord or letting agent at the start of a tenancy, held to cover potential damage or unpaid rent, and legally required to be protected in a government-approved tenancy deposit scheme under the Housing Act 2004.

What this check covers

A property deposit, often referred to as a tenancy deposit, is a financial safeguard paid by a tenant to secure a rental property. In the UK, landlords or letting agents must protect this deposit within 30 days of receipt in one of three government-backed schemes: DPS, MyDeposits, or TDS. The deposit remains protected for the duration of the tenancy and must be returned to the tenant at the end of the tenancy, minus any agreed deductions for damages or unpaid rent. Failure to protect the deposit can result in legal penalties for the landlord.

Key legal requirements

  • Deposit must be protected in an approved scheme within 30 days of receipt
  • Landlord must provide the tenant with prescribed information about the scheme
  • Deposit must be returned to the tenant at the end of the tenancy, minus any agreed deductions
  • Deductions must be justified and agreed upon by both parties
  • Tenants can challenge unfair deductions through the deposit scheme’s dispute resolution service

Why this matters

If a landlord fails to protect the deposit or provide the required information, they may be liable to pay the tenant up to three times the deposit amount as compensation. Additionally, the tenant may be able to challenge eviction notices or pursue legal action to recover the deposit. Protecting the deposit ensures transparency and fairness for both parties, reducing the risk of disputes.
