Probate service (UK)

The UK Probate Service is the official body responsible for validating wills and administering estates where the deceased left assets. It issues the grant of representation (probate or letters of administration) to authorised individuals to manage the estate.

What this check covers

The Probate Service is part of HM Courts & Tribunals Service and operates under the jurisdiction of the Senior Courts Act 1981. It handles applications for legal authority to deal with a deceased person's estate, whether they left a will (grant of probate) or did not (grant of letters of administration). The service ensures the correct distribution of assets according to the will or intestacy rules, and may require inheritance tax calculations to be completed before issuing a grant.

Key legal requirements

  • Determine if a grant of probate or letters of administration is required
  • Submit the correct application form (PA1P for probate, PA1A for letters of administration)
  • Provide the original will (if applicable) and death certificate
  • Pay any applicable inheritance tax before the grant is issued
  • Ensure all executors or administrators are named and eligible

Why this matters

Without a grant from the Probate Service, executors or administrators cannot legally access or distribute the deceased's assets. Delays or errors in the application process can lead to financial penalties, disputes among beneficiaries, or prolonged estate administration. Incorrect handling may also result in claims against the estate for breach of fiduciary duty.
