The application involves submitting the deceased’s will (if applicable), death certificate, inheritance tax forms, and an oath sworn by the executor or administrator.

Key legal requirements

• Submit the correct probate application form (PA1P for wills, PA1A for no will)
• Provide the original will and death certificate (or certified copies)
• Complete and file the relevant inheritance tax forms (IHT205 or IHT400)
• Pay the application fee (unless exempt)
• Swear an oath (either in person or via a commissioner for oaths)

Why this matters

Without a valid grant of probate or letters of administration, executors or administrators cannot legally access or distribute the deceased’s assets.
