Health Records Access Check (UK)

Health records access documents are the request, identity, authority, and disclosure records reviewed to assess whether access to medical records has been handled in line with the applicable UK access and data protection rules.

What is this?

A health-records access review usually looks at who requested the records, on what basis, what authority or consent was supplied, and how the healthcare body responded. The analysis often has to distinguish between a patient's own access rights, third-party requests, and any limits needed to protect confidentiality or another person's information.

Relevant law often includes the UK GDPR, Data Protection Act 2018, confidentiality principles, and sector-specific NHS or healthcare guidance on access to records.

Key legal requirements

  • the requester identity and authority to seek the records should be verified and documented clearly
  • the route used for access should match the requester category, such as patient, representative, or other authorised person
  • any refusal, redaction, or partial disclosure should be supported by a lawful and recorded basis
  • the disclosure pack and correspondence should align with what records are said to exist and what search or review steps were taken

Why this matters

Medical record access cases often involve sensitive data and third-party confidentiality, so weak authority checks or poor redaction reasoning can create significant compliance risk.
