Flat deposit (UK)

A flat deposit refers to a single tenancy deposit paid by a tenant for a rented flat, which must be protected in a government-approved tenancy deposit scheme within 30 days of receipt under the Housing Act 2004.

What this check covers

A flat deposit is a sum of money paid by a tenant to a landlord or letting agent as security against damage, non-payment of rent, or other breaches of the tenancy agreement. In the UK, this deposit must be protected in one of three government-backed schemes—DPS, MyDeposits, or TDS—if the property is let on an assured shorthold tenancy. The deposit is typically equivalent to 4-6 weeks' rent and must be returned at the end of the tenancy, minus any agreed deductions for damage or unpaid rent, subject to the terms of the scheme.

Key legal requirements

  • Deposit must be protected in an approved scheme within 30 days of receipt.
  • Landlord must provide the tenant with prescribed information about the scheme and deposit.
  • Deposit cannot be withheld without justification at the end of the tenancy.
  • Disputes over deductions must be resolved through the scheme’s free dispute resolution service.

Why this matters

Failure to protect the deposit or provide the required information can result in the landlord being unable to evict the tenant using a Section 21 notice and may expose them to a claim for compensation of up to 1-3 times the deposit amount. Tenants risk losing their deposit if deductions are unfairly claimed, so understanding the protection process is essential for both parties.
